Receiving of a patent on a industrial design   The industrial design is a result of the creative activity of a designer in the field of artistic construction. An object of the industrial design is a form, drawing, an image or coloration or a combination thereof defining an appearance of an article and destined to meet aesthetic and ergonomic demands According to the law of Ukraine "the Protection of the industrial design" can not be a industrial design:   Architecture object ( except little architectural forms), industrial, hydrotechnical an other stationary facilities Printed output Objects of instable form from liquid, gaseous, friable, and similar substances, etc.  A patent of industrial design shall come into effect for 10 years from the date of filing with the Patent Office and shall be renewable for a term of no more than 5 years. An industrial design is patentable if it is new and has industrial applicability. The person with the desire of receiving a patent on the industrial design will file an application with Ukrainian Patent office Filing requirements for Ukraine. An application shall be made in Ukrainian language and shall include: request for the patent granting set of photographs of the industrial design description of the industrial design drawing, diagram, chart (if any). After an application has undergone the formal examination, the Patent Office shall forward to an applicant a decision of the patent granting. A patent is granted within 1 month after the registration in the State Register. The rights derived from a patent come into effect from the date of publication of the mention of the patent granting in the Official Bulletin. The patent on the industrial design will give to its owner the right of the exclusive use of the industrial design if such use does not infringe the right of other owners of other industrial designs.
